OVERVIEW

 

Welcome to Free It Up Dance and Entertainment. Throughout the site, the terms “we”, “us”, "Free It Up Dance", and “our” refer to Free It Up Dance and Entertainment . Free It Up Dance and Entertainment offers various services and functions, including, but not limited to, group dance and fitness lessons, private dance lessons, taking bookings for our dance studio “Studio Hire”, providing online classes via Socadance.com, shows and selling merchandise from this website

By visiting our site and/ or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current website / store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

SECTION 1 – GENERAL TERMS

 

  • By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

  • You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

  • A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

 

SECTION 2 - GENERAL CONDITIONS

 

  • Health attestation - By visiting our site and/ or purchasing from us you attest that you are fully able to participate in an exercise regimen of your design or choosing without undue risk.

  • We reserve the right to refuse service to anyone for any reason at any time.

  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

  • You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

  • The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

 

SECTION 2A – IN STUDIO CLASSES

Before attending a dance class at our studio, participants must provide us with their full name, phone number and email address. We will also request that you provide your postcode. If the participant is younger than eighteen (18) years of age, the booking must be made by a legal parent / guardian and noted in the booking form.

By entering our dance studio, you agree and acknowledge the following terms and conditions:

  • Dance classes can involve risk of personal injury. While Free It Up Dance takes all reasonable care in the conduct of its classes, it accepts no responsibility for injury or loss caused during the classes or whilst participants are at or near the studios;

  • You will not attend a dance class at Free It Up Dance if you have a current positive COVID-19 test result, are awaiting the result of a COVID-19 test, have come into contact with a known case of COVID-19 or are experiencing symptoms of cough, sore throat, shortness of breath or fever.

  • All purchases for dance classes are final, non-refundable.

  • You or your legal guardian are responsible for ensuring that you are physically and medically fit for the class;

  • During the class you must take care at all times of your own personal safety;

  • Entry to the class more than ten (10) minutes after the start time is prohibited, as you must participate in the warm-up exercises at the start of the class to prevent the risk of injuries;

  • We sometimes film and/or photograph classes, rehearsals, and activities. It is possible that you will appear in these materials. By accepting this agreement, you allow us the unrestricted right and permission to use your image in printed or digital promotional materials including, but not limited to, websites, social media, flyers, and videos.

  • Students must not attempt a class, or any part of a routine, that is beyond their level of ability;

  • Be respectful and do not behave inappropriately towards other members, guests, our staff and outside providers. Examples of inappropriate behaviour include verbal or physical intimidation, harassment, discrimination on the basis of race, sex, age or any disability another person may have;

  • Inappropriate behaviour, including intoxication or any physical, verbal or otherwise towards any Free It Up Dane employee, contractor, dance class student or guest, may result in cancellation of your booking/purchase and removal from the premises. Free It Up Dance reserves the right to refuse entry to any persons at its absolute discretion;

  • You or your legal guardian are responsible for your own belongings. Free It Up Dance does not accept responsibility for any lost, stolen or damaged property; and

  • Free It Up Dance takes all reasonable care to minimise risk of infection of COVID-19 at its premises, however you attend at your own risk and it accepts no responsibility for illness or loss caused by attending a dance class or related activity.

  • Gift cards purchased for “drop-in” classes or short courses are valid for admission for twelve (12) months from the date of purchase. We cannot provide extensions to the expiry date unless a request is made for an extension for medical reasons and is supported by a medical certificate. The twelve (12) month period is inclusive of any public holiday or Christmas closures.

  • Bookings made / purchased for “short-courses” and “workshops” are only valid for the dates selected when booking. No refunds or exchanges will be made if you are unable to attend a “short-course” or a “workshop” on the dates selected when you make your purchase.

  • Prepaid gift cards cannot be replaced or refunded if lost, stolen or damaged, and cannot be exchanged for cash.

  • The timetable, locations and teachers for all dance classes and workshops may be subject to change without notice.

 

SECTION 3 – STUDIO HIRE

 

3a -INCLUSIONS

The studio hire includes:

  • 6 metres of 1.8m high mirrors

  • A green zone / stretch area with 1.2m x 1.8m mirror

  • Vinyl wood flooring

  • Bright LED lighting

  • Large speaker and mixer that supports connection via USB, audio jack, Bluetooth or RCA.

  • Male + Female Bathrooms

  • Storage cubes for bags / personal items

 

3b – GENERAL HIRE CONDITIONS

Failure to comply with any of these conditions will result in your booking being cancelled by Free It Up Dance.

  • The Hirer must be at least 18 years of age.

  • The person who makes the booking is required to be at the premises or nominate a representative 18 years or older for the duration of hire.

  • Due to covid regulations class size “cannot exceed 20 people” , if government restrictions are in effect. It is the Hirer’s responsibility to ensure capacity is not exceeded.

  • If government restrictions are in effect the hirer must ensure they meet covid safe guidelines for the duration of their hire. E.g. 

    • Enforcing social distancing.

    • Preventing those displaying signs of covid-19 from entering the premises.

    • Keeping accurate records for 28 days of names, emails and numbers of those in the studio.

  • If the studio is being hired for the purpose of classes, the Hirer must email their current public liability insurance to info@freeitupdance.com or freeitupdance@gmail.com . Failure to do so may result in your booking being cancelled.

  • The Hirer must not remove or permit the removal of any furniture, equipment or contents from the studio

  • The hiring is personal to the Hirer. It cannot be assigned in whole or in part. This means that you cannot impart your responsibilities on to other parties or sub-hire to others.

  • Heavy or sharp objects must not be placed near or on the studio mirrors. The studio mirrors are not to be touched.

  • Cash or valuables should not be held on the premises.

  • The Hirer must not make any changes / additions or undertake any building works to the studio. This includes the use of nails, screws, tape on the walls. Only blue tack is permitted for the temporary placement of posters during hire.

  • It is the responsibility of the Hirer to ensure the health and safety of any and all persons in attendance.

  • It is the responsibility of the Hirer to inspect the studio to ensure its condition is safe and fit for the purpose of the hire. Any issues should be reported to Free It Up Dance as soon as possible.

  • No animals are permitted in the premises, other than guide dogs for the visually impaired or registered companion animals and official animals of the NSW Police.

  • The Hirer must respect the other users of the premises at all times.

  • Studio space Hirers have access via the space to male and female bathrooms

  • A Free It Up Dance representative may be onsite during your hire.

  • Facility must be kept in a clean and tidy state. No shoes on furniture, walls, or mirrors and no use of confetti, glitter or items to that effect.

 

3c - PERIOD OF HIRE

  • Bookings are for a minimum of 55 minutes

    • Due to covid safe restrictions back to back classes / hires are not permitted.

    • 5 minutes is allocated between hires to allow for the space to be sufficiently vacated.

  • The studio is available only from the booked commencement time of hire.

  • Early entry or failure to vacate the Studio at the end of the hire period will result in additional charges via your original payment processor.

  • Hours of use are between 7am and 11pm.

  • Loud music and noise is permitted only after 5pm. The studio can be used for activities such a yoga, private lessons, rehearsals with low levels of noise between 7am - 5pm

 

3d - BOOKINGS

  • Hirers must state precisely the type of activity to take place and use the premises for that purpose.

  • Bookings can be made in advance, however for bookings for a future date > 1 month please contact Free It Up Dance to confirm there are no changes to studio availability.

  • Hirers must adhere to the agreed hiring hours. Setting-up and packing up time must be included in the hiring period.

  • Free It Up Dance should be informed immediately in writing of any changes to booking information such as times, contacts, address for invoice etc

 

3e. FEES AND PAYMENT

  • Fees and charges are determined by Free It Up Dance

  • To guarantee your booking, payment must be made in advance and any relevant documentation provided.

  • The Free It Up Dance website accepts credit card payments.

  • For recurring longer-term bookings please contact Free It Up Dance for options.

 

3f. CANCELLATION INFORMATION

Update: 31/1/2021 - Bookings for hires may be rescheduled to another time convenient to you, with sufficient notice as specified below, however please note that cancellations are no longer supported. ​

  • For hires with duration <  4 hrs

    • Hirers must provide 24hrs notice  to reschedule, otherwise the booking and pre-payment will be forfeited.

  • For hires with duration => 4 hrs

    • Reschedule > 4 days notice  - No cancellation/reschedule fee

    • Reschedule  between 4 days and 24hr - reschedule fee equivalent to 25% of the hire fee.

    • Cancellation/reschedule request < 24hrs - Pre-payment will be forfeited.

  • Free It Up Dance and Entertainment reserves the right to cancel bookings where circumstances so warrant. These may include, but are not limited to, emergency situations and adverse environmental conditions, major renovations or for other use. Free It Up Dance will attempt to minimise disruption and provide as much notice as is possible, booking fees will be refunded.

  • ​​Arrival time

    • Late arrivals  - Please note that the studio is not staffed at all hours. If you will be more than 10-15min late please contact us so that staff is aware. Failure to do so may result in your booking being forfeited.

    • ​​Early entry or failure to vacate the Studio at the end of the hire period may result in additional charges. 

    • Bookings will not be extended due to late arrival.​

 

3g. KEYS AND ACCESS

  • A representative will be onsite during your Hire period.

  • In the event you are provided a key, keys must be returned at the end of your hire period by the next working day.  

  • Keys are not permitted to be copied. A key issue fee ($75) will be charged for replacement of lost keys.

 

3h. PROHIBITED USES / ITEMS

  • The studio flooring is not suitable for the purposes of acrobatics, gymnastics or tap dancing.

  • Any dance involving heels, sharp or hard footwear can only be done so if all participants utilise soft coverings / shoe protectors. Non marking shoes are preferred.

  • The studio cannot be hired for events such as birthday parties, bux/hens nights, please contact info@freeitpdance.com if you have queries.

  • The studio can not be hired before 5pm for loud activities such as drumming practice, dance classes with loud music , singing etc.

  • Alcohol and red wine is not permitted on the premises.

  • Use of resins, oil paints, solvents, enamels, aerosols i.e. fixatives, spray paint are not permitted on the premises

  • Open flames or candles are not permitted

 

 

3i. EMERGENCIES

  • If an emergency arises, such as a power failure, blocked plumbing, etc, notify Free It Up Dance immediately.

  • If the issue has arisen from the Hirer’s actions, the Hirer may be charged the emergency call out fee.

  • For critical emergencies call 000 first.

 

3j. SAFETY AND ACCIDENTS

  • The Hirer must familiarise themselves with the exits, fire extinguishers, fire hoses and facility evacuation procedures in case of an emergency.

  • The Hirer must ensure that all exit doors, stairwell and access to fire equipment are kept clear.

  • The Hirer must not place any substance on the floors that would alter or damage the surface.

  • The Hirer is responsible for ensuring that fire equipment is not discharged, used or interfered with for any reason other than its designated purpose.  

  • A first Aid kit is available onsite, however it is also recommended the Hirer should have their own first aid kit.

 

3k. FURNITURE AND EQUIPMENT

  • If the Hirer requires additional furniture and equipment to those available then it is the Hirer’s responsibility to organise. Furniture and equipment must be carried, not dragged on the floor.

  • All electrical equipment brought in by Hirers must be tested and tagged by a qualified electrician.  

  • It is the Hirer’s responsibility to ensure that all furniture and equipment brought in externally for a activity is removed prior to the end of the hire period. Failure to remove such equipment may result in the levying of a further fee.

  • If equipment, furniture or art are left at the Studio after the hire period, we reserve the right to remove them, and if not claimed, to dispose of them.

 

3l - BUILDING SECURITY

If a representative from Free It Up Dance is not onsite, the hirers must ensure to do the following before leaving the premises:

  • Turn off all lights (including in the toilets)

  • Turn of fans/air conditioning

  • Check that all doors and windows are locked.

  • If you leave it is your responsibility to ensure that the Studio is secure. If you have problems locking the building, phone 0401138834.

 

3m - DAMAGE / BREAKAGES / LOSS OF PROPERTY

  • The Hirer is responsible for the full replacement cost of any damage or breakages to the building, its fittings, contents and grounds that take place within their hire period. Any damage must be immediately reported.

  • Damages may be charged retrospectively if the hirer is found to have caused damage which which they failed to report. Security cameras are in use and can be used as evidence.

  • The Hirer is responsible for reporting health and safety hazards. Free It Up Dance does not accept responsibility for the loss or damage of Hirer’s property.

 

3n - PARKING

  • The Hirer should ensure that no vehicle obstructs access in any way, or contravenes any restricted parking signs.

  • Hirers are advised not to leave valuables in vehicles.

 

3p. SMOKE-FREE ENVIRONMENT

  • Smoking is not permitted within 10 metres of entrances. The Hirer is responsible for ensuring that this policy is adhered to.

 

3o. NOISE, NEIGHBOURS AND MUSIC

  • Please consider the interests of the studios neighbours at all times. Activities at the studio should not overly impact on local businesses. Loud music is permitted only after 5pm.

  • If commercial recorded music is used it is the responsibility of the Hirer to comply with all copyright and APRA requirements.

 

3p. SMOKE-FREE ENVIRONMENT

  • Smoking is not permitted within 10 metres of entrances. The Hirer is responsible for ensuring that this policy is adhered to.

SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

  • We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

  • This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

 

SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES

 

  • Prices for our products are subject to change without notice.

  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

  • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

 

SECTION 6 - PRODUCTS OR SERVICES (if applicable)

 

  • Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

  • We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

  • We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

  • We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

 

  • We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

  • You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 8 - OPTIONAL TOOLS

 

  • We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

  • You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

  • Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

  • We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments.   • In no case shall Free It Up Dance and Entertainment  and Free It Up Dance, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

SECTION 15 - INDEMNIFICATION

 

You agree to indemnify, defend and hold harmless Free It Up Dance and Entertainment and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 16 - SEVERABILITY

 

  • In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 17 - TERMINATION

 

  • The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

  • These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

  • If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

 

SECTION 18 - ENTIRE AGREEMENT
